法官的职业伦理对行政官的借鉴意义

法官的职业伦理对行政官的借鉴意义

摘􀀁 要: 当代中国行政官的职业伦理具有泛政治化、大众化的特点。行政官的职业伦理与法治的内在要求不相符, 必将影响行政法治的实现。在行政法治秩序建构方面, “人”--行政官的主观因素相当重要。通过对法官( 兼及法律家其它成员) 与行政官职业伦理的比较, 为行政官伦理的发展与完善, 提供可资借鉴的模式。法官的职业伦理虽然与行政官存在差别, 但两者根本的理念应是一致的, 即法治的精神是法官与行政官共同的伦理基础。。
