A New Interpretation of the Two Implications of "Escape" in Traffic Offences

Abstract:The intention of aggravating the penalty of escaping from the traffic offences is to protect the right of lifeand health of victims firstly or later violated in the traffic offence. In addition to proofs showing the relation betweennon一helping act and result of death，not helping the injured and causative and not removing the road blocks，which lead to the major injury and death of others or the damage of public and private properties，all these shouldbe affirmed as escapes from traffic offences. Death caused by escape includes not helping the injured in the first ac-cident that leads to death，and also not removing the road blocks，which causes the following accidents and leads todeath.
