我国监狱_改革论文

　　摘要
　　就监狱_运行的理论而言，深入研究监狱_运行中的内在矛盾冲突与改革模式的文献较少，探讨其中的内在矛盾具有重要的现实意义。本文在前人规范研究的基础上，把监狱工作的完整性奠定在罪犯劳动的生产职能、监管职能和教育职能的统一上。
　　通过对现行监狱体系内企业职能和监狱职能的并重地位进行实证分析，指出企业职能和监狱职能因对风险的偏好不同而互相掣肘，效率不高。进而指出监狱_改革的方向应当是调整两种职能的并重地位，并提出了另外三种选择：其一，监狱职能居于主导地位；其二，监狱职能和企业职能相分离；其三，企业职能居于主导地位。
