Cooperative Principle in Courtroom Discourse

Abstract:Cooperative principle is a very important principle in daily conversation. As a special component of our daily communication, courtroom discourse is also restricted by the cooperative principle. Based on the Grice’s conversational implicature and cooperative principle theory, this study tends to analyze the speech of different participants in the courtroom in detail. Through this study, we will try to prove the cooperative principle is also applied in the courtroom discourse, and its great function in the process of obtaining the necessary information in the courtroom.

摘要:合作原则是非常重要的交际准则。作为日常交流的特殊组成部分,法庭语言也受到合作原则的约束。本文试图以格莱斯的会话含义理论和合作原则理论为基础,详细分析法庭庭审参与各方的言语。通过本文,我们试图证实合作原则同样应用与法庭言语中,并在获取信息和庭审过程中发挥着巨大的作用。

Cooperative principle, as one of the core ideas in pragmatics, can be used not only in verbal communication, but also in many other fields, such as translation, literature, education, etc. As a kind of social activity, courtroom discourse is also connected with cooperative theory closely.
Courtroom discourse is not merely a process of interaction; it is also a process of information e*change. Although courtroom discourse is a kind of institutional discourse which is much different from the words and phrases used in daily life, linguistic rules, such as cooperative principle, can also be detected in such a specific occasion. The aim of courtroom discourse is to bring about the revelation of the truth by means of language(Lakeoff 1989). Therefore, courtroom discourse can be studied by the modern linguistics, for its close relationship with language.
The study is intended to probe into the application and violation of cooperative principle/theory in courtroom discourse. Its aim is to verify that the cooperative principle is also used and applied in Chinese courtroom discourse. Meanwhile, the study also tries to find the linguistic strategies adopted by all parties including judges, lawyers, public prosecutors and witnesses.
1.2 Method Adopted In This Study
Law is an art of using professional words; Law comes into being through language. In order to have a further understanding of legal language, this study will look into the legal language in the cooperative principle perspective, aiming to emphasizing the importance and necessity of applying the cooperative principle in courtroom discourse.
The study will use the way that combines the cooperative principle theory with the real cases and e*amples to illustrate and discuss. The cases and e*amples used in this study come from http://bjfyzb.chinacourt.org/,an official website founded by Beijing Higher Court and CNTV legal program,in order to keep the objectivity and authenticity of the manuscripts, all materials have been undergone strict choice, record and revision.
1.3 Structure of the Paper
This study will be organized as follows:
Part 1 introduces the research background, the method used in the study, and the importance of the study.
Part 2 presents the theoretical background used to provide a solid foundation for the argument, including conversational implicature, cooperative principle and its ma*ims.
Part 3 will e*plicate the strategies adopted by the participants in the courtroom discourse, including judges, lawyers, public prosecutors and witnesses.
Part 4 is the closing part of the study aiming to make a conclusion that cooperative principle is used in courtroom discourse.
2. Theoretical Foundations
2.1 Conversational Implicature
Grice thinks that to some e*tent, people have the same goal in a conversation in order to produce the e*pected effect. They consciously or unconsciously abide by a cooperative principle in the specific conversation. However, in reality, it is very clear that people in a conversation often break cooperative principle, in other words, some other intentions and meanings may appear beyond what the words they have said. The meanings different from the meaning delivered by them and must be understood through reasoning are called implicatures.
