However, there have e*isted many translations following mechanical word-for-word correspondence, which makes the translations more of Chinglish. The focus of this paper is to determine whether there appears to be a general strategic approach to translations of business contracts.

摘要：该论文的主题是中英文商务合同的翻译，特别是有关翻译过程中思维模式的转换。国际商务合同是一种由来自两个不同国家的代表方所签署的法律文件。由于文化冲突和思维模式的差异给好的翻译带来很大的阻碍，合同翻译急需高质量的翻译来减少翻译错误。然而，现今还是存在很多错误的翻译，那些字字机械式的翻译导致译文变得很中式化。本篇论文就是侧重讨论出一种比较普遍的方法用来翻译合同翻译。

1. Introduction

1.1 Reasons Leading to Mistaken Translation
A large number of mistaken translations have led to commercial disputes. Some were caused by cultural conflicts, such as shortage of knowledge of local government laws and regulations. Some were created by poor understanding of English words. For e*ample, when translating “insurance policies”, translator may put the policy into a plan of action agreed or chosen by a political party, a business. While actually, “insurance policy” here means a written contract between a person and an insurance company. Other mistaken translations are also affected by inadequacy of conte*tual analysis.
1.2 Characteristics of Other Forms of Stylistics
Since business contracts are very strict in the use of words, and sentence structure, so as to be more formal, accurate, and brief. In my point of view, translations of business contract need not to be beautiful like sonnet, and should not be like a speech. Both of the writing styles leave people different and boundless imagination and creation because the object of poems and speeches is to evoke emotions, to lead people to adore the beauty beyond the articles. Therefore, both of them lack accuracy in describing sensitive events.
1.3 Translations on Functional Views
This paper focuses on semantic views and functional views on business contracts translation. The communicative translation theory of Eugene Nida not only emphasizes language meaning transform, but also functional equivalence. However people of different countries may have different patterns of thoughts, for e*ample, the principle of English language is of connective-prominence ne*us, for Chinese language verb-prominence ne*us. This paper deals with the problem of how to e*change the patterns of thoughts during business contract translation.
